Terms
Terms of Service
The short version
- Quotes are good for 30 days. You’ll see any price change before we do extra work.
- Cancel or reschedule free with 24 hours’ notice. Later than that, no access when we arrive, or calling off the work once we’re on site carries a $79 trip fee (not if you decline a new price we give you on site). Weather reschedules are always free.
- Taxable services are priced “+ tax”. Pay by card or bank payment (ACH) through our official invoice. Our crew never takes cash, checks or payment apps.
- Something not right? Tell us within 48 hours and we’ll come back and redo that part at no charge. Report any damage within 48 hours with photos.
- Holiday lighting deposits are refundable until 14 days before your install.
- Texts are optional. Reply STOP anytime, or HELP for help.
This summary is for convenience. The full Terms below control.
1.About these Terms
These Terms of Service (the “Terms”) are an agreement between you and Mindful Movers, Inc., a Tennessee corporation doing business as Crestwork Home & Property Care (“Crestwork,” “we,” “us” or “our”). They apply when you:
- use CrestworkCare.com or any page we link to these Terms (the “Site”);
- request a quote for, book, or receive any service from Crestwork (the “Services”).
You must be 18 or older to book Services. You accept these Terms when you use the Site, check a box or click a button that refers to them, accept a quote or booking confirmation that links to them, or let us start work. If you don’t agree, please don’t use the Site or book Services.
Which document controls. If a written quote, service agreement or plan agreement that both of us accepted for a specific job says something different from these Terms, that document controls for that job. Everything it doesn’t address is covered here. Our Privacy Policy explains how we handle your information. It is a separate document that also applies.
Business customers. Property managers, apartment communities, builders and other business accounts usually work under a separate written agreement. Where there isn’t one, these Terms apply.
2.Using our website
Information on the Site. We work to keep the Site accurate, but service descriptions, photos, service areas and posted prices are general information. Posted prices describe typical jobs. Your written quote or booking confirmation sets your actual price. If we find a pricing or typing error, we’ll correct it and tell you before any work starts, and you can cancel without charge.
Acceptable use. You agree not to: use the Site for anything unlawful; submit false information or someone else’s contact details in our forms; try to break into, overload or disrupt the Site; scrape or copy it with automated tools; or upload anything harmful, such as malware.
Our content. The Crestwork name, logos, text, photos, video and design of the Site belong to us or the people who licensed them to us. You may view and print pages for your own personal use. Any other use needs our written permission.
Other websites and tools. The Site links to services run by others, such as online booking and payment portals, maps, and review sites. Their own terms and privacy policies apply when you use them, and we aren’t responsible for them.
The Site itself. We provide the Site “as is” and can’t promise it will always be available or error-free. This applies to the Site only, not to the quality of our Services, which the “Our work” section covers.
3.Reviews and feedback
Your honest reviews are always welcome. You’re free to post honest reviews, ratings and comments about Crestwork anywhere, good or bad. Nothing in these Terms limits that, and we will never charge you or take action against you for an honest review.
We never pay for positive reviews, and no discount or credit ever depends on what a review or testimonial says. If someone received a discount connected to sharing feedback or a testimonial we use, we say so. We don’t post fake reviews or remove honest ones from the Site because they are negative.
Ideas and feedback. If you send us suggestions, we may use them to improve our business without owing you anything. If you agree to let us use your photos, video or testimonial in marketing, the separate release you sign controls that use.
4.Text messages
Our Text Messaging Terms apply only if you join one of our text programs. Joining is optional and separate from agreeing to these Terms. If this summary differs from our Text Messaging Terms or Privacy Policy, those documents control. In short:
- Two separate, optional programs: Service Texts (about your request and job) and Offers & Reminders (marketing, up to 4 per month, sent 8 a.m. to 8 p.m. your local time and never on Sundays). Joining is never a condition of buying anything from us.
- How you join: by checking the box for a program on our website form, or by telling us on a call or in person that we may text you about your job. If you text us first, we reply about your request. Marketing texts go only to people who checked the offers box.
- Stopping: reply STOP to any text. A STOP ends all texts from Crestwork, service and marketing. Our moving brand, Mindful Movers, runs its own text programs with its own opt-out, so a Crestwork STOP doesn’t change texts you agreed to get from Mindful Movers; reply STOP to a Mindful Movers text to end those. If you reply STOPALL, or tell us to stop all texts from our company, we’ll stop texts from both Crestwork and Mindful Movers. You can also opt out by calling us, emailing us, writing to us or telling a team member. A STOP takes effect at once on that number, and in our other systems normally within one business day (always within 10 business days). Reply START to the same number to resume Crestwork texts.
- Help: reply HELP or call (615) 660-0917, or email info@crestworkcare.com. Message and data rates may apply. Message frequency varies.
- Privacy: no mobile information is shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
5.Quotes, pricing and changes
Quotes are good for 30 days from the date we send them, unless the quote says otherwise.
How Crestwork is priced. Most Crestwork services are flat-priced from your home’s details, such as stories, gutter footage, where the dryer vent exits, or the size of a junk load. Larger or unusual jobs are quoted individually.
Sales tax. Prices for taxable services are shown “+ tax” on our Site and your quote. Your quote and invoice always show the sales tax separately. Business accounts are quoted before tax, with applicable sales tax added.
Extra charges. Some jobs carry extra charges, such as travel for homes outside our service areas, same-day booking, work before 7 a.m. or after 7 p.m., Sundays, long carries and stairs. They’re listed on our Prices & Policies page and always shown on your quote before we start. On taxable services, extra charges are taxed too.
Junk removal. Junk removal is priced by how much of our trailer your items fill. We confirm the price on site before we load anything. Heavy materials such as concrete, dirt, brick, tile or roofing carry an extra charge, which we quote first.
When a job turns out different. Your quote is based on what you told us and what we could see. If the job turns out materially different, for example more items, extra stories, harder access, or work that wasn’t described, we’ll explain the change and the new price before doing the extra work. You can approve it, adjust the scope, or stop. We won’t charge for work you didn’t approve, except steps we have to take right away to keep people or property safe.
Offers and discounts follow the terms printed with them. Unless the offer says otherwise, discounts can’t be combined, have no cash value, and can’t be applied to jobs already completed or invoiced.
6.Scheduling, access and safety
Your technician arrives within the arrival window on your confirmation. Traffic, earlier jobs and weather can cause delays. If we’re running late, we’ll let you know as soon as we can.
What we need from you. Please:
- have an adult (18+) with authority over the property present when we start and finish, or arrange access with us ahead of time;
- clear pathways, and keep pets and children away from the work area;
- give us access to an outdoor water spigot (pressure washing and windows) and working exterior outlets (holiday lighting);
- get any approval your HOA requires before we install holiday lighting or other exterior work;
- tell us about gate codes, HOA rules, irrigation heads, invisible pet fences, or anything else we could damage that we can’t see;
- tell us about hazards ahead of time, such as weak floors or stairs, mold, pests, damaged wiring, or hazardous materials.
Keys and codes. If you give us keys, lockbox codes or alarm codes, we keep codes in an encrypted password manager and keys locked up, and only team members who need them for your job can access them. Keys are returned, and codes deleted, within 30 days after the job or maintenance plan they were given for ends. Please share codes by phone or in person, not by text.
Safety comes first. We may pause, change or decline any part of a job that we reasonably believe is unsafe for our crew, your family or your property. That includes threatening behavior toward our team. We’ll explain why and work with you on a safe alternative.
Weather. Outdoor work depends on weather. If rain, wind, ice or lightning makes the work unsafe or would hurt the result, we’ll reschedule at no charge.
7.Cancellations and rescheduling
24 hours’ notice is free. You can cancel or reschedule without charge up to 24 hours before your appointment. Holiday lighting installs follow the deposit terms below.
Trip fee. A $79 trip fee applies if you cancel with less than 24 hours’ notice, if we arrive and can’t get access, or if you call off the work once we’re on site, unless you decline a price change we present on site. We never charge it when we stop work for safety or weather. Weather reschedules are always free.
Holiday lighting deposits. Holiday lighting needs a 50% deposit to reserve your install date. The deposit is fully refundable if you cancel at least 14 days before your scheduled install. After that it’s non-refundable, because we’ve reserved your install date, turned away other homes for that slot, and completed your design and prep work. If we can’t complete your install for any reason on our side, we refund your deposit in full.
If we have to cancel or reschedule, you owe nothing for that appointment. We’ll work to find the soonest date that works for you.
How to cancel or reschedule. Call us, or text us a full sentence. A one-word text like “CANCEL” or “STOP” is treated as a request to stop our texts, not as a job cancellation.
Your legal cancellation rights. Some sales made at your home give you a legal right to cancel within three business days, under the FTC Cooling-Off Rule or the Tennessee Home Solicitation Sales Act. If your purchase qualifies, we’ll give you the required written notice, and nothing in these Terms limits that right.
8.Payment
Homeowners pay when the job is done, by credit or debit card or bank payment (ACH) through our secure payment system, unless your quote says otherwise. If a bank payment is returned, we’ll ask you to pay again, and you’re responsible for the returned-payment fee our bank charges us.
Holiday lighting requires the 50% deposit at booking. The balance is due within 7 days of the invoice we send after the dusk check of your completed display.
For your protection: our crew members never accept cash, checks, or payment apps (such as Venmo, Cash App or Zelle) as payment for a job. Only pay through our official invoice or payment link. If anyone asks you to pay another way, call us at (615) 660-0917.
Business accounts that we’ve approved for invoicing may pay by check or bank transfer, on Net 30 terms unless your agreement says otherwise. Past-due balances accrue interest from the due date at 10% per year, or at a higher rate set in your signed account agreement, up to the maximum Tennessee law allows. The account is also responsible for reasonable costs of collection, including attorney’s fees, as the law allows.
Questions about a charge. Please contact us within 30 days of the charge, and before you dispute it with your card issuer or bank, so we can work it out quickly. This doesn’t limit any rights you have with your card issuer. Refunds go back to your original payment method.
9.Our work and service-specific terms
We’ll do your work carefully and in a workmanlike way, following the manufacturer’s instructions and common industry practice. If something we did isn’t right, tell us within 48 hours and we’ll come back and redo that part at no charge. This covers our workmanship, not new debris, storms, or conditions that arise after our visit.
Service-specific terms.
- Gutter cleaning. Standard service covers gutters reachable from a ladder, up to about 20 feet at the eave. Taller sections are quoted separately, and steep, ladder-only roofs carry the extra charge on our Prices & Policies page. Cleaning doesn’t include gutter repair, underground drain lines, or guard installation unless quoted. If we find loose, rusted or damaged gutters, we’ll show you.
- Dryer vent cleaning. We clean the vent duct from the dryer connection to the outside exit. We don’t repair dryers or work on gas or electrical connections. If a connection looks unsafe, we’ll stop and tell you. Ducts hidden inside walls and ceilings can’t be fully inspected, and we’ll tell you about any damage we find. If your vent didn’t need cleaning, we charge the vent inspection price shown on your quote in place of the cleaning price. We record your vent’s airflow after cleaning. If your dryer starts taking longer to dry within 12 months, call us and we’ll re-test the airflow at no charge. If buildup has returned, re-cleaning is quoted at our regular price.
- Pressure washing and window cleaning. We test before we wash. Surfaces that are already weak can be affected by normal cleaning, such as peeling or chalking paint, oxidized siding, cracked concrete, worn sealant or failed window seals. We’ll point out these conditions before we start.
- Junk removal. You confirm that you own the items or have the right to dispose of them. Once items are loaded they become ours to donate, recycle or dispose of, and we can’t return them. We can’t take hazardous materials (paint, chemicals, fuel, propane tanks, asbestos, medical waste), tires, or anything illegal to haul.
- Home setup and assembly. We don’t do work that requires a license, such as electrical, plumbing, gas, HVAC or structural work. We aren’t responsible for defects in or missing parts from products you purchased.
- Holiday lighting. Lights, clips, cords and timers are provided as a seasonal rental and stay our property. Your service includes design, installation, maintenance during the season, takedown, and storage. If something goes out during the season, we’ll have a technician out within 48 hours of your call, weather permitting. If an outlet or GFCI trips, please try resetting it first; outlets, circuits and other electrical problems in your home are yours to fix, with your electrician. We attach with clips, never nails or staples into your roof. You provide working exterior outlets, and we don’t do electrical work. Bulb failures and normal weather wear are covered by your service. If lights are damaged by you, your guests, pets or other contractors, we may charge the replacement cost. If lights are stolen or vandalized, we replace them free once per season; after that, replacement is charged at our cost. We take your display down after the season, usually in January, on a date we schedule with you.
- Moving labor. Moving labor requested through Crestwork is performed by Mindful Movers, our moving brand, under its own terms, which you’ll receive when you book. Mindful Movers texts you only if you join its own text program; otherwise we call.
- Maintenance Plans. Recurring Crestwork Maintenance Plans have their own plan terms, which you’ll see and agree to separately before you’re charged. Those plan terms cover billing, renewal and cancellation as Tennessee law requires.
10.Damage and claims
Your home. If our work damages your home or property through our negligence, we’ll repair it or pay the reasonable cost of repair. We aren’t responsible for:
- particleboard or pressboard furniture damaged during assembly, disassembly or normal handling;
- conditions that existed before we arrived, such as rotted fascia, loose or rusted gutters, brittle or granule-worn shingles, crushed or disconnected hidden ducts, failed window seals, peeling paint, or faulty wiring or outlets;
- damage from weather, animals or third parties after our work is done; or
- items or conditions you didn’t tell us about and we couldn’t reasonably see, such as invisible fences, irrigation heads or buried lines.
If we find a problem during the job, we’ll stop and show you before going further.
How to report a claim. Tell us within 48 hours after the job is finished, with photos, by calling or texting (615) 660-0917 or emailing info@crestworkcare.com. If you’ve opted out of texts, sending us one doesn’t restart them; we’ll follow up by phone. Please give us a chance to inspect the damage before it’s repaired, unless an emergency repair can’t wait.
We’ll tell you whether we accept your claim within 10 business days after we receive your photos, or after our inspection if we schedule one, which we’ll do within 5 business days. Claims we accept are repaired, replaced or paid within 30 days of acceptance. Damage reported after 48 hours will still be reviewed, but we may decline damage we can’t reasonably connect to our work.
Insurance. We carry general liability, workers’ compensation, commercial auto and umbrella coverage. A certificate of insurance is available on request.
11.Limits of liability and your responsibilities
To the fullest extent Tennessee law allows:
- We aren’t liable for indirect, incidental or consequential losses, such as lost wages or profits, storm damage after our visit that our work didn’t cause, spoiled event plans, or delays caused by others.
- Our liability for your use of the Site itself (as opposed to our Services) is limited to $100.
These limits don’t apply to bodily injury caused by our negligence, to loss or damage caused by our gross negligence, recklessness, intentional misconduct or theft, or to anything the law doesn’t allow us to limit. Nothing in these Terms takes away rights you have under the Tennessee Consumer Protection Act or other laws that can’t be waived.
Your responsibilities. You agree to give us accurate information about the job. You’re responsible for losses that come directly from information you knew was false, from hazardous items you didn’t disclose, or from items you didn’t have the right to give us. That includes fines and the cost of handling them.
12.Job photos
We may take photos or short videos of work areas before, during and after service. These are for quality checks, training, and documenting claims, and they’re kept with your job record.
We publish photos or video of your home in marketing only with your permission or a signed release. When we do, we never show your street address or house number, we blur house numbers and license plates, and we don’t geotag posts.
13.Resolving disputes
Talk first. Most problems are solved with a phone call. If that doesn’t work, send us a written description of the problem and what you’d like done, by email or mail, using the contact details under “Contact us” below. Before either of us files a lawsuit, we’ll each give the other written notice and 30 days to try to resolve it. This doesn’t apply to emergency relief or to claims that would otherwise expire.
Tennessee law and courts. These Terms are governed by Tennessee law. Any lawsuit must be brought in the state courts of Davidson County, Tennessee. Either of us may bring a claim within its limits in General Sessions Court, which hears civil claims up to $25,000.
14.Changes and general terms
Changes. We may update these Terms from time to time. The date at the top shows the latest version. Changes apply to Site use and bookings made after we post them. A job you already booked stays under the Terms in effect when you booked it, unless you agree otherwise. Changes to our Privacy Policy and Text Messaging Terms follow the notice rules in those documents.
Things outside our control. We aren’t responsible for delays or failures caused by events we can’t reasonably control, such as severe weather, natural disasters, road closures, utility outages, illness, or government orders. We’ll reschedule as soon as practical.
Other terms.
- If any part of these Terms is found unenforceable, the rest still applies, and that part is enforced to the extent allowed.
- If we don’t enforce a term right away, we haven’t given up the right to enforce it later.
- You may not transfer these Terms to someone else without our consent.
- These Terms, together with your quote or confirmation, our Privacy Policy, our Text Messaging Terms (if you joined a text program), and any separate written agreement, plan terms or media release described above, are the full agreement between us about their subject.
- Headings are for convenience only.
